copyrights, trade secrets, patents or other intellectual property
rights in this site and/or each of its computer software modules,
except for the portions that may be owned by Dolphin Trade
& Travel various third party providers and distributors.
Schedule, fare, and availability data may be protected by
copyright of Dolphin Trade & Travel. You may not
disassemble, decompile, reverse engineer or otherwise derive
source code from the software, reproduce, distribute, publish,
license, modify, create derivative works from, transfer, sell,
rent or lease any information, software products or services
obtained from this site without the express written permission of Dolphin

USE
OF SITE |
| You
may only use our site if you are at least 18 years of age and can
enter into binding contracts (our site is not available for use by
minors). You are responsible for maintaining the secrecy of your

legitimate reservations or purchases. You may not use our site: to
make any false, fraudulent or speculative reservation or any

that could constitute or encourage conduct that would be

reasonable commercial efforts to keep our site available on a
24-hour/7-day-a- week basis, subject to necessary scheduled

SPECIAL
REQUESTS |
| If
you have special requests (such as aisle seats, smoking room, pet
accommodations, view, floor location, etc.), you must contact the
Supplier or Airline directly after your purchase is confirmed and
make appropriate arrangements, subject to availability. When
making a purchase on the Site, you expressly accept the
possibility that the Supplier may not satisfy such special
requests. No purchase or reservation may be canceled based on the
failure of a Supplier to satisfy special requests. |

REGISTRATION |
| We
do not require registration for you to use the Site. However, if
you choose to purchase a Package, you will be asked to provide
certain information that we must have to process your purchase,
such as your name, billing address, phone number and email
address. In addition, if you sign up to receive our emails, you
will be asked to provide information such as your first name,
email address, zip code and preferred departure city. In such
cases, you agree to provide accurate, current and complete
information about yourself as prompted by our Site. You
acknowledge that, if any information provided by you is untrue,
inaccurate, not current or incomplete, we reserve the right to
terminate this Agreement and your use of the Site. |

IDENTIFICATION |
| You
shall defend and indemnify Dolphin Trade & Travel and
its third party providers and distributors from and against any
claim or cause of action brought by or on your behalf in excess of
the liability described herein or by third parties as a result of
your use of this Web site. |

OWNERSHIP
AND RESTRICTIONS ON USE |

Site is owned and operated by us in conjunction with others
pursuant to contractual arrangements, and the Materials (and any
intellectual property and other rights relating thereto) are and
will remain the property of Company and its licensors and
suppliers. U.S. and international copyright, trademark and other
laws thereof protect the Materials and the selection, compilation,
collection, arrangement and assembly, and you acknowledge that
these rights are valid and enforceable. You may not copy,
reproduce, republish, upload, post, transmit or distribute
Materials or other content or information available on or through
the Site in any way without our prior written permission. The
Materials may be used solely to the extent necessary for your
authorized use of the Site, as provided in this Agreement or as
expressly authorized in writing by us or, if so indicated in

violation of our copyright and other proprietary rights, and is
strictly prohibited. You acknowledge that you do not acquire any

licensors and Suppliers, and others. The Trademarks owned by us,
whether registered or unregistered, may not be used in connection
with any product or service that is not ours, in any manner that
is likely to cause confusion with customers, or in any manner that
disparages us. Nothing contained on the Site should be construed
as granting, by implication, estoppels or otherwise, any license
or right to use any Trademark without our express written
permission, that of our licensors or suppliers, or the third party
owner of any such Trademark. Misuse of any Trademarks is
prohibited, and we will aggressively enforce our intellectual
property rights in such Trademarks, including via civil and

OF LIABILITY |

TRADE & TRAVEL ASSUMES NO RESPONSIBILITY, AND SHALL NOT BE
LIABLE FOR, ANY DAMAGES TO, OR VIRUSES THAT MAY INFECT YOUR
COMPUTER EQUIPMENT OR OTHER PROPERTY ON ACCOUNT OF YOUR ACCESS TO,
USE OF, OR BROWSING IN THIS SITE OR YOUR DOWNLOADING OF ANY
MATERIALS, DATA, TEXT, IMAGES, VIDEO OR AUDIO FROM THE SITE. IN NO
EVENT SHALL DOLPHIN TRADE & TRAVEL OR ANY THIRD PARTY
PROVIDERS OR DISTRIBUTORS BE LIABLE FOR ANY INJURY, LOSS, CLAIM,
DAMAGE, OR ANY SPECIAL, EXEMPLARY, PUNITIVE, INDIRECT, INCIDENTAL
OR CONSEQUENTIAL DAMAGES OF ANY KIND (INCLUDING, BUT NOT LIMITED
TO LOST PROFITS OR LOST SAVINGS), WHETHER BASED IN CONTRACT, TORT,

WAY CONNECTED WITH (I) ANY USE OF THIS SITE OR CONTENT FOUND
HEREIN, (II) ANY FAILURE OR DELAY (INCLUDING, BUT NOT LIMITED TO
THE USE OF OR INABILITY TO USE ANY COMPONENT OF THIS SITE FOR
RESERVATIONS OR TICKETING), OR (III) THE PERFORMANCE OR NON
PERFORMANCE BY DOLPHIN TRADE & TRAVEL OR ANY THIRD
PARTY PROVIDERS OR DISTRIBUTORS, EVEN IF SUCH PARTY HAS BEEN
ADVISED OF THE POSSIBILITY OF DAMAGES TO SUCH PARTIES OR ANY OTHER
PARTY. |

JURISDICTIONAL
ISSUES |

States. We make no representation that Materials available on or
through the Site are appropriate or available for use in other
locations. Those who choose to access the Site from other
locations do so on their own initiative and at their own risk, and
are responsible for compliance with local laws, if and to the
extent local laws are applicable. We reserve the right to limit
the availability of the Site and/or the provision of any service,
program, film or other product described thereon to any person,
geographic area or jurisdiction, at any time and in our sole
discretion, and to limit the quantities of any such service,

ATTORNEY'S
FEES |
| If
Dolphin Trade & Travel or its affiliates take any
action to enforce this User Agreement and these terms and
conditions, such parties will be entitled to recover from you, and
you agree to pay, all reasonable and necessary attorney's fees and
any cost of litigation, in addition to any other relief, at law or
in equity, to which such parties may be entitled. |

TERMINATION
|
Dolphin
Trade & Travel may terminate this User Agreement and these
terms and conditions and/or the provision of any of the services
at any time for any reason, including any improper use of this
site or your failure to comply with these terms and conditions.
Such termination shall not affect any right to relief to which Dolphin
Trade & Travel and its third party providers and
distributors may be entitled, at law or in equity. Upon
termination of this User Agreement and these terms and conditions,
all rights granted to you will terminate and revert to
Dolphin
Trade & Travel and its third party providers or distri-
butors, as applicable. |

DISCLAIMER |

THE
SITE, THE MATERIALS, ANY PRODUCT OR SERVICE OBTAINED THROUGH THE
SITE AND ANY SOFTWARE PROVIDED ON THE SITE IS PROVIDED "AS
IS" AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR
IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE
LAW, COMPANY AND ITS AFFILIATES, LICENSORS, SUPPLIERS,
ADVERTISERS, SPONSORS AND AGENTS DISCLAIM ALL WARRANTIES, EXPRESS
OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF
TITLE, NON-INFRINGEMENT, ACCURACY, MERCHANTABILITY, AND FITNESS
FOR A PARTICULAR PURPOSE, AND ANY WARRANTIES THAT MAY ARISE FROM
COURSE OF DEALING, COURSE OF PERFORMANCE OR USAGE OF TRADE.
Applicable law may not allow the exclusion of implied warranties,
so the above exclusions may not apply to you.
COMPANY
AND ITS AFFILIATES, LICENSORS, SUPPLIERS, ADVERTISERS, SPONSORS
AND AGENTS DO NOT WARRANT THAT YOUR USE OF THE SITE OR THE
SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, THAT DEFECTS
WILL BE CORRECTED, OR THAT THE SITE, THE SERVER(S) ON WHICH THE
SITE IS HOSTED OR SOFTWARE ARE FREE OF VIRUSES OR OTHER HARMFUL
COMPONENTS. YOU ACKNOWLEDGE THAT YOU ARE RESPONSIBLE FOR OBTAINING
AND MAINTAINING ALL TELEPHONE, COMPUTER HARDWARE AND OTHER
EQUIPMENT NEEDED TO ACCESS AND USE THE SITE, AND ALL CHARGES
RELATED THERETO. YOU ASSUME ALL RESPONSIBILITY AND RISK FOR YOUR
USE OF THE SITE AND THE SOFTWARE AND YOUR RELIANCE THEREON. NO
